1. About DgreNxt

DgreNxt is an AI-enabled insights and assessment platform designed to help individuals and organizations gain structured understanding of behavioral patterns, operating styles, strengths, and development areas. The platform is built to support self-awareness, reflection, learning, and informed decision-making.

DgreNxt provides decision-support insights only. The Services are not intended to guarantee outcomes, predict success, certify abilities, or determine professional or personal results. All insights generated are contextual and must be interpreted responsibly.

2. Eligibility and User Representation

The Services are intended for individuals who are at least eighteen (18) years of age. By using DgreNxt, you confirm that you meet this requirement or that you are using the Services on behalf of an organization with appropriate authority.

You represent and warrant that all information provided by you is accurate, complete, lawful, and voluntarily submitted. DgreNxt reserves the right to restrict, suspend, or terminate access if any information is found to be misleading, inaccurate, or unlawful.

3. Scope and Acceptance of These Terms

These Terms apply to all users of DgreNxt, including website visitors, registered users, free users, paid users, and organizational or enterprise users. Continued access to or use of the Services constitutes ongoing acceptance of these Terms, including any modifications made from time to time.

DgreNxt may update these Terms to reflect changes in services, platform features, legal requirements, or operational practices. Updated Terms will be published on the website and will take effect upon posting.

4. Nature of Services and Disclaimer

The Services offered by DgreNxt may include behavioral and operating-style assessments, AI-generated reports and summaries, dashboards, interpretive frameworks, and learning or development recommendations.

All outputs generated by DgreNxt are indicative, probabilistic, and contextual in nature. They are based on user-provided information, self-reported responses, and AI-driven analytical models. The Services are intended solely for informational, developmental, and self-reflection purposes.

DgreNxt does not provide medical, psychological, clinical, legal, financial, or employment advice. The platform does not diagnose conditions, certify competence, predict outcomes, or guarantee results. Any decisions taken using DgreNxt insights remain entirely the responsibility of the user or the organization using the platform.

5. User Responsibilities and Acceptable Use

By using the Services, you agree to act responsibly, ethically, and in good faith. You are expected to provide honest responses, engage with assessments sincerely, and use generated insights constructively and lawfully.

You must not attempt to manipulate responses, distort outcomes, reverse engineer platform logic, extract proprietary frameworks, or misuse insights in any manner. You also agree not to use the Services to discriminate against, label, or cause harm to any individual or group.

You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account.

6. Organizational and Enterprise Use

When DgreNxt is used on behalf of an organization, the organization is responsible for ensuring that informed consent has been obtained from all individuals whose data or responses are submitted to the platform. The organization must also ensure compliance with applicable employment, labor, and data protection laws.

DgreNxt acts solely as an insights and analytics provider. It does not participate in or influence organizational decisions related to hiring, promotion, compensation, performance evaluation, or termination. Responsibility for such decisions rests entirely with the organization.

7. Intellectual Property Rights

All content and materials available through DgreNxt, including assessment frameworks, Core Powers, scoring logic, interpretive models, reports, dashboards, text, graphics, designs, software, algorithms, and workflows, are the exclusive intellectual property of DgreNxt.

Users are granted a limited, non-exclusive, non-transferable right to access and use the Services for personal or internal organizational purposes only. Any copying, resale, redistribution, sublicensing, or use of DgreNxt materials to create competing products or services is strictly prohibited.

8. Data Protection and Privacy

DgreNxt values user privacy and processes data in accordance with its Privacy Policy. The Privacy Policy explains what data is collected, why it is collected, how it is stored, how long it is retained, and what rights users have with respect to their data.

By using the Services, you consent to the collection and processing of your data as described in the Privacy Policy.

9. Payments, Billing, and Taxes

Certain Services offered by DgreNxt require payment. Pricing details, features, and access terms are displayed at the time of purchase. Payments are processed through authorized third-party payment gateways.

Prices may be subject to applicable taxes as required by law. DgreNxt reserves the right to modify pricing, plans, or features at any time, with changes reflected on the website.

10. Refund and Cancellation Policy

Due to the digital nature of the Services, including instant access to assessments, reports, and enablement infrastructure, refunds are not automatic.

Refunds may be considered only in limited circumstances, specifically in cases of verified technical failure attributable to DgreNxt that prevents access to the purchased service, or where the user has not attempted, accessed, or consumed any part of the purchased package after successful payment.

In eligible cases, 70% of the amount paid may be refunded, while 30% of the amount shall be deducted as enablement charges. These enablement charges cover non-recoverable costs incurred by DgreNxt, including platform provisioning, system setup, access enablement, payment processing, and operational overheads.

Refunds will not be issued if the user has attempted or partially completed any assessment, accessed reports or dashboards, or if dissatisfaction arises from the nature or interpretation of insights provided. All refund requests are subject to verification and review and must be raised within a reasonable timeframe.

11. Reports, Outputs, and Accuracy

Reports and insights generated by DgreNxt reflect user inputs and system analysis at a specific point in time. Behavioral insights may vary across different assessments or as circumstances evolve.

While DgreNxt strives to provide meaningful and structured insights, it does not guarantee accuracy, completeness, or applicability to every individual or situation. Users acknowledge that behavior and performance are dynamic and context-dependent.

12. Platform Availability

DgreNxt aims to provide reliable access to the Services but does not guarantee uninterrupted or error-free operation. Temporary interruptions may occur due to maintenance, upgrades, technical issues, or external factors beyond our control.

13. Third-Party Services

The Services may integrate with third-party platforms such as payment processors, communication tools, or analytics providers. DgreNxt is not responsible for the availability, actions, or data practices of third-party services. Use of such services is governed by their respective terms and policies.

14. Suspension and Termination

DgreNxt reserves the right to suspend or terminate access to the Services if these Terms are violated, if fraudulent or abusive activity is detected, or if required payments are not completed.

Users may discontinue use of the Services at any time.

15. Limitation of Liability

To the maximum extent permitted by law, DgreNxt shall not be liable for indirect, incidental, special, or consequential damages arising from the use of the Services. Any liability, if established, shall be limited to the amount paid by the user to DgreNxt in the twelve (12) months preceding the claim.

16. Indemnification

You agree to indemnify and hold harmless DgreNxt from any claims, losses, damages, or liabilities arising from your misuse of the Services, violation of these Terms, or breach of applicable laws or third-party rights.

17. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising in connection with the Services shall be subject to the exclusive jurisdiction of the courts located in India.
